Kulture Inc. (the “Company”) hereby establishes these LIVENODE TICKET Terms of Use (these “Terms”) with respect to the use of ”LIVENODE TICKET”, the ticket sales platform service operated by the Company (including any service provided under a changed service name or URL; the "Service").

In using the Service, customers shall, after fully understanding these Terms and each of the provisions separately established by the Company, including the “Privacy Policy” and the “Notation Based on the Specified Commercial Transactions Act”, agree to comply with the contents thereof in advance. In addition, by using the Service, customers shall be deemed to have agreed to comply with these Terms.

Chapter 1 General Provisions

Article 1 (Definitions)

The terms used in these Terms shall have the meanings set forth in the following Items.

  1. (1)“Applicable Event” means an event, concert, other entertainment performance, or any services provided by a Ticket Seller ancillary thereto, which is subject to the Service.
  2. (2)“Applicable Ticket” means a ticket (including an electronic ticket; the same shall apply hereinafter) for participating in an Applicable Event or receiving services provided at an Applicable Event.
  3. (3)“Applicable Electronic Ticket Data” means an Applicable Ticket that has been converted into electronic data, including applications for PC or smartphone users, authentication patterns, and similar items.
  4. (4)“Member” means a person who has applied for membership registration for the Service in accordance with these Terms and whose application has been approved by the Company. In order to use the Service, a person must become a Member of the Service in advance.
  5. (5)“Ticket Purchaser” means a Member of the Service who wishes to purchase, applies to purchase, or has purchased an Applicable Ticket.
  6. (6)“Ticket Seller” means a Member of the Service who, acting as the promoter or organizer of an event, concert, or other similar activity, wishes to sell or sells tickets for such event through the Service.
  7. (7)“User” means any person who uses or attempts to use the Service and includes, without limitation, visitors to the Site, Members, Ticket Purchasers, and Ticket Sellers.
  8. (8)“Site” means the website for providing the Service (URL: https://ticket.livenode.jp), including the website as modified in the event that the content, URL, or other aspects thereof are changed.
  9. (9)“Event Page” means a website designated separately by the Company or established within the Site on which a Ticket Seller posts or advertises details of an Applicable Event and the terms and conditions for the sale of tickets or similar items.
  10. (10)“Agreement” means the agreement formed between the Company and a User, the terms and conditions of which are set forth in these Terms.
  11. (11)“Ticket Delivery URL” means the URL of a website containing information necessary to obtain Applicable Electronic Ticket Data, which is delivered through the Service or through any other medium or method designated by the Company.
  12. (12)“Mobile Device,” “Telephone Number,” and “Email Address” mean, respectively, a mobile phone, smartphone, tablet, or other device used by a User in connection with the use of the Service, and the telephone number and email address associated therewith.

Article 2 (Scope of Application of These Terms)

  1. These Terms shall apply to Users as provided in the respective provisions hereof. The Service constitutes a “standard transaction” as prescribed in Article 548-2, Paragraph 1 of the Civil Code, and these Terms constitute “standard terms and conditions” as prescribed in the same Paragraph.
  2. The Company outsources all or part of the operations relating to the Service to LetterFan Inc. (the “Contractor”). Users shall be deemed to have acknowledged that the Company may outsource all or part of the operations relating to the provision of the Service to the Contractor and may provide such Contractor with information relating to the individual User (including, without limitation, “personal information” as defined in Article 2, Paragraph 1 of the Act on the Protection of Personal Information (Act No. 57 of 2003) ("APPI")) to the extent necessary for the performance of the outsourced operations.
